Terms and conditions for on-line sale of the products of Maison Stern Graveur

Attentive to cater for its clients needs, the Stern Graveur company has elected, for some of its products, to set up an electronic commerce on-line sales service by means of the Internet network .

Scope

The present general conditions of sale are applicable to all sales of Stern Graveur items made via the www.sterngraveur.com on-line trade site. The customer acknowledges the present general conditions of sale before placing his/her order. The validation of his/her order bears out acceptance without limitation or reserve of the present general conditions of sale.
According to the provisions of Article 1369-1 of the Civil code, the present general conditions of sale may be retained by anyone connecting to www.sterngraveur.comInternet site, by means of a computer recording and may, in addition, be copied by the Customer, by means of printing; the present general conditions of sale will be applicable for as long as they appear on the www.sterngraveur.com Internet site. If the present general conditions of sale were to remain accessible to the public on any third-party Internet site or by any other means, after the date of their due deletion from www.sterngraveur.com Internet site, they would however have no binding nature or would not be opposable to Stern Graveur Company.

Orders via Internet

Orders may be placed via the Internet on both versions, French and English, of the www.sterngraveur.com Internet trade site. Telecommunications and usage charges to access the www.sterngraveur.com website remain expenses for the account of the Customer or user..
Photographs, graphic designs and descriptions of products presented for sale have only an indicative purpose; the “Stern Graveur” company will by no means be liable for such. Customers may obtain further information by contacting “Maison Stern Graveur” by telephone.
The Customer should upon completion of his/ her first product order open an account with “Société Stern Graveur” and fill an on-line order form, specifying some mandatory information for his/ her selection to be validated by the Company.
Should the on-line connection be inactive during an extended period of time, then the selection of items done before such inactivity cannot be guaranteed. In such case, the Customer will be asked to start afresh his/ her selection.
All steps necessary to conclude the sale will be spelled out on the www.sterngraveur.com Internet site according to the provisions of Article 1369-1 of the Civil Code. In application of the provisions of Article 1369-2 of the Civil Code, the Customer will be given the opportunity before the confirmation of the order to verify the details of same, the total price and to correct possible errors, thus expressing his/ her agreement. After validation of the order by the Customer, the Company "Stern Graveur" will acknowledge receipt by electronic means of the same order.
Nonetheless the sale will be final only after the Company (Stern Graveur) sends to the Customer a confirmation of the order specifying the dispatch of the items. Debit will cover only the dispatched items plus accrued charges for transport and forwarding.

Cancellation and Rejection of Orders

According to the provisions of Article L.122 1 of the Consumer Code (Code de la consommation), the Stern Graveur company will be entitled to cancel or reject any order we consider abnormal, dishonest or insincere.
Furthermore the Stern Graveur company will be entitled to cancel or reject any order from a customer with whom would exist a dispute concerning the payment of a previous order.
In case of cancellation of the contract by the Customer, the deposit shall not be refunded regardless of product ordered. Besides, in case of cancellation of a "Your Image" and/or "Custom Works" order, the buyer shall be bound to pay in full the amount of the supply paper ordered. When the printing job, per se, is not carried out or the press-proof is not validated by the Buyer, neither the printing lumpsum nor the various printing options are invoiced.

Prices

Prices of items are inclusive of all taxes. Delivery charges are extra.
The all tax inclusive (TTC) price of each of the items listed by a customer/ user and their related transport and delivery charges, will be indicated at the time of his/ her connection to the www.sterngraveur.com Internet website.
According to the provisions of Article L.121 19 of the Consumer Code (Code de la consommation), the customer will receive, upon delivery, for each of the items, the written confirmation of the price paid detailing the item sale price and the delivery charges.

Payment

The payment of Customer purchases is made by bank charge card or credit card (secure payment executed directly by our bank: Société générale ...), by bank transfer or by bank cheque payable to "Stern Graveur". In case of payment by cheque, “Stern Graveur” will process the order only after the cheque has been received.
The Customer bank charge card or credit card is charged at the time the order is processed. To this end, the customer when placing an order with “Stern Graveur” on-line, warrants that he/ she is the holder of the bank charge or credit card and that the details of same card are true and his/ her own; then he/ she enters either via telephone or in a secured Internet environment the sixteen digits number, the expiry date, and when applicable the cryptograph numbers from the back of his/ her bank card. If for any reason (stop-payment, bank-server rejection ...), the actual payment of sums due by the Customer would fail, the on-line purchase process on the Internet will be cancelled.

Delivery

The items will be delivered at the Customer's place of business after payment has been received in the amount due in relation to the order. According to the provisions of Article L.121-20-3 of the Consumer Code (Code de la consommation), the delivery of ordered items will take place within 30 days starting from the next day after the order is received or the bank cheque receipt when applicable, provided the payment is in full. Time limits or periods possibly quoted by the Company (Stern Graveur) will be deemed estimates only. This period may be modified in case of agreement between the Company "Stern Graveur” and the Customer; nevertheless “Stern Graveur” will not be held liable for consequences arising from a delay or an error in delivery, a stock shortage of paper or discontinuation of one or several paper references by a supplier. “Stern Graveur” shall not be liable for any delay in delivery resulting from force majeure (strike, flood, fire ...).

Transfer of property

The transfer of property of the products to the buyer, shall be completed only after full payment by the latter, regardless of the delivery date of the aforementioned products. Moreover, no product shall be dispatched before full payment of the invoice. However, the transfer of risk, loss and deterioration of the products will be effective as of the delivery to the buyer and his/ her reception of the aforementioned products. “Stern Graveur” cannot thus be held liable for any possible deterioration of the dispatched parcel or of its contents while in transport.

Compliance - Warranty

It is the Customer responsibility to verify that the items delivered to him/her are in conformity with the order. Should the delivered items not correspond to the order, the Customer should notify the Company "Stern Graveur" of same.

Terms for Custom Work.

“Stern Graveur” the Company undertakes to submit to the Customer 3 design projects according to the chosen theme stipulated on the order form. The customer may then choose one of the projects and request modifications be made to image, colour, text and/or layout provided same do not exceed two shuttle proofs. “Stern Graveur” undertakes to respect to the best of its knowledge and craftsmanship the taste and request of the Customer and nevertheless reserves the right to refuse any modification or order which would not concur with the spirit of its creations. Design projects shall be paid at time of order and shall not be refunded should the order be cancelled. Any request for a new design project in excess of the original three mentioned above, shall be covered by a new invoice.

Claims - Information request

All information request, complaint or question relative to the terms of sale or the products of the Company "Société Stern Graveur" should be directed by customers to Stern Graveur - 115, boulevard Richard Lenoir - 75011 Paris. No claims shall be considered past a period of 15 days after delivery of the works.

Your personal information is treated with the utmost confidentiality; during your purchases, we require only the information essential to process your order and to maintain the quality of our services. The exposure of some particulars displayed on items designed by Stern Graveur is subject to prior authorization from the concerned individual or legal entity.

Intellectual Property Rights

The trademark " Stern Graveur ", as well as all the logos or brands and in general all other trademarks, illustrations, images and logos appearing on "Stern Graveur" items, their accessories or their packaging, whether registered or not, are and remain the exclusive property of the Company Stern Graveur . Any reproduction, modification or use of these trademarks, illustrations, images and logos, in total or in part, on any ground by any means and on any media, without the prior and express consent of the Company "Stern Graveur", is strictly prohibited. The same is true of any combination or conjunction with any other trademark, symbol, logo and in general any distinctive mark or sign intended to form a complex logo. The same shall also apply to all copyrights, patents, sketches and patterns which are the property of the Company "Stern Graveur". All designs and printing works will be branded with the name "Stern Graveur Paris".

Litigation - Governing Law

The present general conditions of sale shall be construed in compliance with French law.
In case of problem arising at the time of order or from the delivery of the "Stern Graveur" items, the Customer will be entitled to seek an out-of court good will solution, notably with recourse to a consumers' association or a council of his/her choice, before any legal action.
Any dispute resulting from the interpretation and application of the present Terms and Conditions will fall under the exclusive jurisdiction of French Courts.
